General Terms and Conditions of Sale and Data Protection (GDPR)

1. Orders

Placing an order implies full and unconditional acceptance of these General Terms and Conditions of Sale.
A minimum of €100 excl. tax (pro forma) is required for any order.

2. Shipping Fees – Mainland France

Free shipping for orders over €295 excl. tax.
Discounted products are not included in the calculation of the free-shipping threshold.

Specific Conditions – Salt Lamps

For any order including salt lamps with a total weight exceeding 20 kg:

Free shipping applies only for orders over €490 excl. tax.
Below this amount, shipping fees are charged based on the actual weight of the goods, according to the carrier’s applicable rates.

These conditions take precedence over any other delivery clause in these General Terms and Conditions.

3. Discounts

Discounts cannot be combined.
During sales or promotional periods, the usual discount is automatically suspended.

4. Shipping Fee Contribution

A fixed contribution of €15 excl. tax is applied to orders below €295 excl. tax.
For French overseas territories (DOM-TOM) and international destinations, shipping fees are fully borne by the buyer.

5. Distributors

Minimum order amount: €5,000 excl. tax (pro forma).
Shipping fees are entirely borne by the buyer.
A valid SIRET number and APE/NAF code corresponding to a wholesale activity are mandatory.

Any order placed and not honoured, or not cancelled immediately after validation, will lead to the permanent deletion of the customer account.
Inactive accounts may also be removed.

Any order below €100 excl. tax will automatically be shipped to a pickup point.

6. Order Processing Time

Orders are prepared within 24 to 72 hours.
During peak periods, this timeframe may be extended.

Express orders placed before 11:00 AM are shipped the same day; however, 24-hour delivery is not guaranteed.
Express fees are added to usual shipping fees.

7. Transport and Delivery

For deliveries outside mainland France, shipping fees are communicated at the time of dispatch.

Any change of delivery address or added information after dispatch will be invoiced.

Delivery times (24–72h in mainland France) are indicative only and cannot justify penalties, cancellations, or compensation.

Any parcel returned due to failed delivery will be resent at the buyer’s expense.
If the order is cancelled, outbound and return shipping costs remain the responsibility of the buyer.

The buyer must check the goods upon receipt and note any relevant reservations on the carrier’s delivery slip.
They have 48 hours (no later than the next working day) to report:

non-conformity,
damaged goods,
quality issues.
Any claim submitted after this period will be rejected.

8. Payment

Payment must be made upfront via:

instant bank transfer,
credit card,
PayPal,
bank cheque.

No discount is granted for early payment.
No goods are shipped before payment is received.

In case of late payment:

interest will be charged at 1.5 times the legal interest rate,
a €15 excl. tax administrative fee will apply,
all collection costs are borne by the buyer,
all outstanding amounts become immediately payable.

Any file transferred to a collection agency will be automatically increased by 15%, payable by the buyer.

For payments via PayPal, PayPal fees are entirely borne by the buyer.

ARABESK reserves the right to modify previously granted payment conditions in case of incident.

9. Exchange – Returns

Defective goods may be returned or exchanged within 7 days from the shipment date.

10. Retention of Title

In accordance with the French law of 12 May 1980, goods remain the property of ARABESK until full payment is received.

11. Claims

Any claim must be submitted within 7 days after receipt of the goods.

12. Jurisdiction – Competent Court

In the event of dispute, the Commercial Court of TOULOUSE (France) shall have exclusive jurisdiction, regardless of delivery location or payment method.

13. Applicable Jurisdiction

Any dispute relating to the formation, performance, or interpretation of the contract shall be submitted exclusively to the Commercial Court of TOULOUSE.

14. Personal Data Protection (GDPR)

Within the scope of its commercial activity, ARABESK collects and processes personal data in compliance with the EU General Data Protection Regulation (GDPR) 2016/679 and applicable French laws.

14.1 Data Collected

Data collected may include:
name, company name, postal address, email, telephone number, SIRET, APE/NAF, order and payment information.

14.2 Purposes of Processing

Data is processed solely for:

managing and fulfilling orders,
invoicing and accounting obligations,
customer account management,
commercial communication and after-sales service,
compliance with legal and regulatory requirements.

14.3 Legal Basis

Data processing is based on:

performance of the contract,
legal obligation,
legitimate interest,
consent (for marketing communications).

14.4 Data Recipients

Data may be transmitted only to:

carriers and logistics partners,
IT and payment service providers,
accounting professionals,
legal authorities when required.

No data is sold, transferred, or shared with unauthorised third parties.

14.5 Data Retention Period

10 years for accounting documents,
3 years for commercial and marketing data,
the time strictly necessary for processing orders.

14.6 Rights of the Data Subject

In accordance with GDPR, the customer has the right to:
access, rectification, erasure, objection, limitation, portability, and withdrawal of consent.

14.7 Data Security
