Terms of Sales
General Terms and Conditions of Sale and Data Protection (GDPR)
1. Orders
Any order implies full and unconditional acceptance of these General Terms and Conditions of Sale.
A minimum amount of €100 excluding VAT in pro forma is required for any order.
2. Shipping costs – Metropolitan France
Free shipping from €295 excluding VAT.
Discounted products are not included in the calculation of the free-shipping threshold.
Specific conditions – Salt lamps
For any order including salt lamps with a total weight exceeding 20 kg:

Free shipping applies only from €600 excluding VAT.

Below €600 excluding VAT, transport costs are charged according to the actual weight, in accordance with the carrier’s rates.
For any order of more than 20 kg of salt lamps, delivered outside France, transport costs are entirely borne by the customer.
A re-adjustment of the transport cost may be applied after the order has been prepared.
These conditions prevail over any other clause relating to transport.
3. Discounts
Discounts are not cumulative.
During sales periods or promotional operations, the usual discount is automatically suspended.
4. Contribution to shipping costs
A contribution of €15 excluding VAT applies to any order below €295 excluding VAT.
For overseas territories (DOM-TOM) and international deliveries, transport costs are borne by the buyer.
5. Distributors

Minimum order: €5,000 excluding VAT in pro forma.

Transport costs entirely borne by the buyer.

Obligation to provide a SIRET number and an APE/NAF code corresponding to wholesale activity.
Any order not fulfilled or not cancelled immediately after validation will result in the permanent deletion of the customer account.
Inactive customer accounts may also be deleted.
6. Processing times
Orders are prepared within 24 to 72 hours; this timeframe may be extended during periods of high activity.
Express orders placed before 11:00 a.m. are shipped the same day (24-hour delivery not guaranteed).
Express charges are added to standard shipping costs.
7. Transport and delivery
For any delivery outside metropolitan France, shipping costs are communicated at the time of dispatch.
Any address modification after dispatch will be charged.
Delivery times are indicative only and may not give rise to any penalty, cancellation or compensation.
Any parcel returned due to delivery failure will be re-shipped at the buyer’s expense.
In the event of cancellation, incurred costs (outbound and return) remain at the buyer’s expense.
The buyer must check the goods upon receipt and state any reservations on the carrier’s delivery note.
The buyer has 48 hours (at the latest the first working day following receipt) to report:

non-conformity,
-
defects,
-
damaged parcels.
Any claim submitted after this period will be rejected.
Any order below €150 excluding VAT will be shipped to a pickup point.
8. Payment
Payment is due upon order by:
-
instant bank transfer,
-
credit/debit card,
-
PayPal,
-
cashier’s cheque.
No discount is granted for early payment.
No delivery will be made before receipt of payment.
In the event of late payment:
-
interest at a rate of 1.5 × the legal interest rate,
-
€15 excluding VAT in administrative fees,
-
recovery costs charged to the buyer,
-
immediate payment of all sums due.
Any file referred to debt collection or legal proceedings will be increased by 15%, at the buyer’s expense.
For any payment via PayPal, PayPal fees are borne by the customer.
ARABESK reserves the right to modify payment terms in the event of an incident.
9. Exchange – Return
Defective goods may be returned or exchanged within 7 days after shipment.
10. Retention of title
In accordance with the law of 12 May 1980, ARABESK retains ownership of the goods until full payment has been made.
11. Claims
Any claim must be made within a maximum period of 7 days following receipt of the goods.
12. Jurisdiction
In the event of a dispute, the Commercial Court of TOULOUSE shall have exclusive jurisdiction, regardless of the place of delivery or the method of payment.
13. Applicable jurisdiction
Any dispute relating to the formation, performance or interpretation of the contract shall fall exclusively within the jurisdiction of the Commercial Court of TOULOUSE.
14. Personal data protection (GDPR)
As part of order management and commercial relations, ARABESK collects and processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) and applicable data-protection laws.
14.1 Data collected
First name, last name, company name, address, email, telephone number, SIRET, APE/NAF, order and payment information.
14.2 Purposes

order management and tracking,
-
invoicing, accounting and after-sales service,
-
customer account management,
-
compliance with legal obligations,
-
commercial communications (subject to consent).
14.3 Legal basis
-
contractual performance,
-
legal obligation,
-
legitimate interest,
-
consent where required.
14.4 Recipients
Data may be transmitted only to:

carriers,
-
IT service providers,
-
payment service providers,
-
accounting firms,
-
authorities where legally required.
No data is sold or transferred to unauthorised third parties.
14.5 Data retention period

10 years for accounting documents,

3 years for commercial data,
-
the period strictly necessary for order processing.
14.6 Buyer’s rights
The buyer may exercise the following rights:

rectification,

erasure,

objection,

restriction,

14.7 Data security
